The position of the vice president Prof. Yemi Osinbajo and the governors of the six South-West States that laws establishing the Amotekun security initiative should be enacted is unnecessary according to a legal expert Godswill Mrakpor.
Barr. Mrakpor told SignatureTv that the Nigerian constitution has already made provision for security initiatives like Amotekun by declaring that every Nigerian has the right to self-defense anytime he or she is under threat.
Barr. Mrakpor explained that enacting any law to establish Amotekun could be over-ridden by a federal law nullifying Amotekun because only the federal government has the power to establish a police force or any organ that can function like the police.
He explained further that Amotekun should be established as a self-defense mechanism and armed with Dane guns in accordance with the provisions of the constitution which empowers governors to give Dane gun licenses.
He however cautioned that operatives of Amotekun cannot carry sophisticated rifles and must not detain or persecute any offenders but can arrest and prevent the commission of any crime
